RENSSELAER COUNTY, N.Y. -- The Rensselaer police officer accused of driving drunk in a crash that killed his passenger has been arraigned.

Mark Fusco, 22, has been charged with aggravated vehicular homicide, manslaughter and aggravated driving while intoxicated.

Police say Fusco was driving drunk near Third Avenue Extension and Grove Street in East Greenbush last month when he crashed into a tree. His passenger, Sean Murphy, 22, was thrown from the car and died. Fusco is the son of Rensselaer police chief Rick Fusco.

The younger Fusco has been placed on leave. He was released on $10,000 bail.
